1. Agreement to Terms

These Terms of Service ("Terms") govern your use of BalloonifyIQ, an AI-powered dimension reading application ("Service") provided by Kowalski Precision LLC ("Company", "we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms.

2. Description of Service

BalloonifyIQ is a web-based application that uses artificial intelligence and optical character recognition (OCR) to read dimensions from technical drawings and PDF documents. Our Service includes:

• AI-powered dimension extraction from PDF files
• Manual annotation tools for technical drawings
• Data export capabilities (PDF and CSV formats)
• Training data collection to improve AI accuracy
• User account management and usage tracking

3. User Accounts and Registration

3.1 Account Creation

To use our Service, you must create an account by providing accurate and complete information, including a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibilities

You agree to:

• Provide accurate and truthful information during registration
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Use the Service only for lawful purposes and in accordance with these Terms

4. Free Trial and Subscription Terms

4.1 Free Trial

New users receive a 7-day free trial with up to 60 AI-powered dimension readings. The trial begins automatically upon account creation. No payment information is required during the trial period.

4.2 Trial Limitations and Notifications

During your trial, you will receive notifications when you have 30, 15, 5 AI dimensions remaining. After your trial expires or you exhaust your trial usage, you must subscribe to continue using the AI-powered features of the Service.

4.3 Subscription Plans

Upon trial expiration, the following subscription plans are available:

• Standard Plan: $9/month for 60 AI dimension readings
• Pro Plan: $14/month for 200 AI dimension readings

4.4 Billing and Payment

Subscriptions are billed monthly in advance. Payment is due immediately upon subscription activation. Usage limits reset at the beginning of each billing cycle.

4.5 Service Continuation

If you choose not to subscribe after your trial expires, you will no longer be able to access the AI-powered dimension reading features. Your account data will be retained in accordance with our Privacy Policy.

5. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Upload malicious files or attempt to compromise system security
• Reverse engineer or attempt to extract proprietary algorithms
• Use the Service for any illegal or unauthorized purpose
• Share your account credentials with others

6. Intellectual Property Rights

6.1 Service Content

The Service, including all software, algorithms, user interface, and related technology, is owned by Kowalski Precision LLC and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

6.2 User Content

You retain ownership of any PDF files or documents you upload to the Service ("User Content"). By uploading User Content, you grant us a limited license to process, analyze, and store such content solely for the purpose of providing the Service to you.

6.3 Training Data

We may use anonymized data derived from your use of the Service to improve our AI algorithms and service quality. This data will not include any personally identifiable information or specific content from your uploaded documents.

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

8. Service Availability and Modifications

8.1 Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that may temporarily affect service availability.

8.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice of material changes that affect your use of the Service.

9.1 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Accuracy Disclaimer

While we strive for accuracy in our AI-powered dimension reading, we do not guarantee 100% accuracy. Users are responsible for verifying all dimensions and measurements extracted by the Service before using them for any critical applications.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOWALSKI PRECISION LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Termination

10.1 Termination by User

You may terminate your account at any time by contacting our support team. Upon termination, your access to the Service will cease, and your account data will be handled in accordance with our Privacy Policy.

10.2 Termination by Company

We may terminate or suspend your account and access to the Service immediately, without prior notice, if you breach these Terms or engage in any conduct that we determine to be inappropriate or harmful to the Service or other users.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts located in Michigan.
